  • The Antideficiency Act for Acquisition Professionals — One-Day Essentials— a focused look at the single most important fiscal-law constraint: what the Antideficiency Act forbids, why it matters, and how to stay clear of a violation.

Course Description:

The Antideficiency Act is one of the most important laws you work under — and one of the few where you, personally, are on the hook. If you work for the federal government, this is information you need to know.

The Antideficiency Act carries administrative penalties (such as written reprimand, counseling, demotion, suspension from duty without pay, or removal from office), criminal penalties (a fine of up to $5,000 and/or imprisonment of up to 2 years), and potential exposure to a federal contractor's civil claim for damages suffered. And, to make matters worse, every violation also triggers mandatory reporting — reporting the violation and violator by name, to the President, Congress, and the Comptroller General.

We can teach you everything you need to know about the Antideficiency Act to protect yourself and your agency. We start with the tenets — what the Antideficiency Act actually prohibits, in plain terms. You'll see where the law comes from, how it connects to the purpose and time rules (such that a purpose or timing mistake becomes an ADA violation).

Then we look at what matters most: what this means for you. We cover the traps that live in the contract actions and simple steps you can take to avoid the risk of violation. We cover unauthorized commitments, how a contract that isn't fully funded creates exposure, how options, modifications, and "just get started" requests can obligate the government before the money is there, and how voluntary services become a risk when a contractor offers to begin work early. We also look at severable services that cross fiscal years, and what happens when you exercise an option with the wrong year's money. By the end you'll know where the danger actually sits in your own work, how to protect yourself and your organization, and what to do if you think a violation may have happened. And to ensure you can find the answers to questions that come up day-to-day, we’ll teach you how to find and navigate the Antideficiency Act itself. This course is packed with best practices and lessons learned — interesting and engaging stories that provide full context to these requirements.

This course is taught by Melinda Milheim, JD, who spent her federal career in the acquisition workforce. She served as a Contract Specialist and COR for the U.S. Navy and the Department of Health and Human Services / Indian Health Service, where she worked on more than $7.7 billion in federal contracts. She draws on that experience, along with her law degree and MBA studies, to teach the “why” behind the “how” — so participants leave with sharper judgment, not just a stack of slides. An award-winning DAU/WarU (DAWIA and FAI) instructor, she has taught more than 1,000 federal acquisition workforce students across 20-plus agencies.

Best for: anyone in the federal government who needs to protect themselves and their organization from the risks of Antideficiency Act violations. No prior fiscal-law background is assumed as this course teaches the topic from the foundation up.

Format: Available as a one-day (8 CLPs/0.8 CEU), three-day (24 CLPs/2.4 CEU), or five-day (40 CLPs/4.0 CEU) course, delivered in person or virtually. Phoenix Canyon issues every attendee a certificate of completion documenting the number of training hours as well as CEUs and CLPs earned, which eligible attendees may apply toward Continuous Learning or Professional Development requirements at their organization’s discretion. Phoenix Canyon is a DAU/WarU equivalent course provider.
