This course is for federal government personnel and contractors who want to understand commercial buying under the Revolutionary FAR Overhaul and apply it with confidence.
The Revolutionary FAR Overhaul rebuilt Part 12, cut roughly 30% of the clauses, and added construction to the definition of commercial services — making commercial buying the streamlined, preferred default, with more flexibility than before.
This course teaches you to make sense of those changes and apply them with confidence. We develop an understanding of what a commercial product or service is — and what it isn't — what a determination requires and when, and how to use market research to make the call. We also cover what you need to know about terminations for commercial products and services. And we work through how to document the determination — building a written record that captures your reasoning and the evidence behind it, so the determination stands up to review, audit, or challenge down the road. Throughout, we work from the most current guidance, including the RFO FAR Part 12 itself, the RFO FAR Part 12 Practitioner Album, and the RFO FAR Companion.
This course is taught by Melinda Milheim, JD, who draws on her law degree, MBA studies, and the experience she earned working on more than $7.7 billion in contracts as a Contract Specialist and COR at the U.S. Navy and the Department of Health and Human Services / Indian Health Service.
